Are funds 'gilt-edged'?

Investment funds are not expressly mentioned in the German Civil Code (BGB) as a safe investment form. However, funds for the investment on behalf of persons lacking legal capacity may be permissible if a guardianship or support court approves this in individual cases. This has already happened in numerous cases.

Many criteria are taken into account in court decisions, such as the security of the fund and its economic advantages over other gilt-edged investments. The assets held by the investment fund will also be taken into account.

BVI keeps a list of known cases in which courts have approved the investment of money by trustees in investment funds. It is intended as a guide and does not claim to be exhaustive.
